GENERAL SALES CONDITIONS

 

I. Application

In the absence of other prior arrangements with the « Compagnie des Bateaux Mouches ® », the present general sales conditions are applicable to all the cruises and related services provided by the company–including catering and entertainment. These conditions prevail over any other general purchase conditions which are not binding for the « Compagnie des Bateaux Mouches ® » in any way. Purchasing or booking a cruise or a service implies full acceptance of the present general sales conditions.

 

II. Reservation and cancellation

Reservations for Lunch and Dinner cruises are mandatory (except when extra seats are available) and can be made by mail, by Email, by fax, by phone or at one of our booking desks.

Tickets will be delivered by Email. Upon request, tickets may be delivered by regular mail but an additional fee will apply to cover shipping costs.

Tickets for Regular cruises may be collected at one of our automated ticket machines or at the desk on the pier. To do so, customers will need to enter a reservation number which is sent by Email, by phone or by fax when the tickets are purchased.

 

Lunch or Dinner Cruises for individual clients (parties of less than 15 people)

 

In the absence of other prior arrangements with the « Compagnie des Bateaux Mouches ® », booking is definitely registered after the totality of the order amount has been prepaid.

Extra passengers will be admitted on board depending on availability. Vouchers will only be accepted if they are issued by a company or a third party approved by the « Compagnie des Bateaux Mouches ®».

Individual clients who fail to cancel reservations 72 hours in advance at least will be charged the total price of the reservation by the « Compagnie des Bateaux Mouches ®».

Reservations cancelled between 72 and 24 hours prior to departure can be changed to another date which shall not exceed 6 months after the original date of departure, depending on availability and in conditions that shall not exceed those initially agreed. The « Compagnie des Bateaux Mouches ®» reserves the right to sell unoccupied seats to other customers.

 

Lunch or Dinner Cruises for groups (parties of more than 15 people)

 

The « Compagnie des Bateaux Mouches ®» must be informed of the exact number of passengers three working days prior to departure. This number cannot be diminished by more than 10% in order to get a refund and refunds will only be possible if the minimum number of passengers for privatized cruises is secured.

Any increase in the number of passengers initially agreed is subjected to approval by the « Compagnie des Bateaux Mouches ®».

Customers who book thirty working days in advance may put a seven-working day option, after which 50% of the total price must be paid as a deposit. In case of cancellation, the deposit is nonrefundable.

Customers who book less than 15 days in advance must pay 50% of the total price as a deposit upon booking. In case of cancellation, the deposit is nonrefundable.

The remaining 50% must be paid at least 7 working days prior to departure, after which no cancellation is possible.

Parties of more than 15 people must choose a set menu 7 days prior to departure at least.  If they fail to do so, our Chef will choose a set menu for the whole party.

Exceptional extension of the reservation deadlines may apply to special occasions such as Valentine’s Day, Mother’s Day, July 14th and New Year’s Eve.

On such occasions, the total order amount must be paid upon booking by both individual passengers and groups and tickets will be nonrefundable and non-exchangeable.

 

III. Prices, billing and payment

In the absence of other prior arrangements with the « Compagnie des Bateaux Mouches ® », the prices applicable are those set at the date of the reservation. Prices are revised once a year every 1st of April.

Deferred billing is subjected to prior agreement with the « Compagnie des Bateaux Mouches ®». In this case, each invoice must be paid by cheque or bank transfer upon reception and no more than 15 working days after it has been issued. Any delay in payment will automatically lead to the billing of interest, without other formalities, calculated on the amount owed (tax-exclusive) and at an interest rate 1.5 times higher than the legal rate, in conformance with law 92-1442. Such interests will be applicable from the day after the deadline for payment has expired. No discount will be made for cash payments.

On special occasions such as listed above, special prices and menus will be available to both individual customers and groups.

 

IV.  Cruise operation

1)Obligations of the « Compagnie des Bateaux Mouches ®»:

The « Compagnie des Bateaux Mouches ®» is fully committed to all appropriate means for ensuring the smooth functioning of its cruises within the conditions specified at the time of reservation.  In no circumstances may the « Compagnie des Bateaux Mouches ®» be held responsible for delays, changes in schedules or duration of cruises resulting notably from a force majeure, water hazards or orders from the port authorities, nor will it refund customers or offer compensation in such cases.  If necessary, the itinerary may be changed without prior notice.

For regular cruises, the price does not include commentaries which are complimentary and optional.

 

2)Customer obligations:

- Individual passengers or groups (all members) must be present at the pier at least 15 minutes prior to departure time. People or groups who fail to be there on time will not be able to claim refund or compensation.

- As far as privatized cruises are concerned, the « Compagnie des Bateaux Mouches ®» reserves the right to shorten the duration of the cruise proportionally to the client’s delay with the resulting consequences on the services provided.

- For safety reasons and to ensure that order is maintained on board, passengers must follow the instructions of the crew from the very moment they are invited to embark. Passengers will be allowed to board at the time specified on the contract.

- Pets, animals or dangerous items are not allowed on board.

- The « Compagnie des Bateaux Mouches ®» cannot be held responsible for stolen or damaged items such as clothes, hand luggage, objects (cameras, mobile phones, etc.) on the pier or on board, nor can it accept responsibility for stolen or damaged vehicles left on the car park.

- The « Compagnie des Bateaux Mouches ®» reserves the right to charge customers for damage caused to onboard equipment by himself/herself or by any member of his/her group.

- Passengers on Lunch and Dinner cruises are required to dress suitably. The « Compagnie des Bateaux Mouches ®» reserves the right to refuse to take on board any passenger who would not be suitably dressed.

- Access to the engine room, the control deck or the kitchen is strictly restricted to crew members.

 

Art performances by providers other than the « Compagnie des Bateaux Mouches ®»

Entertainment and performances are under the responsibility of the « Compagnie des Bateaux Mouches ®». Clients who wish to organize performances and entertainment themselves must ask a special dispensation and produce  the following documents: quotation or invoice from the service provider or hiring certificate of the artists who will perform, a valid certificate of the passenger’s or the provider’s civil liability insurance. Failure to produce the aforementioned documents 2 working days prior to departure will result in artists or providers being refused access on board.

Service providers other than those hired by the « Compagnie des Bateaux Mouches ®» are not allowed to use sound or lighting equipment or instruments belonging to the company.

 

V.Insurance and liability:

Only people who can produce a valid ticket or boarding pass issued by the « Compagnie des Bateaux Mouches ®» may claim compensation.

The cruises are subject to rules applicable to inland navigation, and the  « Compagnie des Bateaux Mouches ®» reserves the right to decide whether the river is navigable or not. As a result, cruises are subject to cancellation or change at any time from the day when the tickets are purchased until departure time, in accordance with the aforementioned rules and regulations or when poor weather conditions may jeopardize the passengers’ safety.  The « Compagnie des Bateaux Mouches ®» cannot be held responsible for accidents resulting from failure to follow the present general sales conditions or general rules and regulations and reserves the right to claim compensation for any harm or damage resulting from such a failure.

The « Compagnie des Bateaux Mouches ®» cannot be held responsible for damages to passengers resulting from one of the following: sudden rise in water level, thunderstorm, and collision with another ship when the other ship is fully or partially responsible for the accident or any other unpredictable event.

The « Compagnie des Bateaux Mouches ®» denies any responsibility for lost items or items fallen overboard or for any damage to the passengers’ hand luggage, clothes or personal belongings.

 

VI. Disputes:

Disputes relative to the present general sales conditions and to the accruing cruises and services it covers will be subject solely to French jurisdiction and French law. Only courts within the district of the Court of Appeal of Paris will have jurisdiction over such disputes except if the « Compagnie des Bateaux Mouches » should decide otherwise.

 

The French version of the present general sales conditions prevails over this translation in case of dispute.
