GENERAL TERMS AND CONDITIONS OF SALE
I. GENERAL PROVISIONS
The performance of all services provided by the COMPAGNIE DES BATEAUX MOUCHES® (sightseeing cruises, dining, privatizations, entertainment, marketing of the Mademoiselle Mouche area, etc.) is subject to these General Terms and Conditions of Sale, unless special provisions are contractually agreed with the customer or partner. These General Terms and Conditions of Sale set out all the rights and obligations of the COMPAGNIE DES BATEAUX MOUCHES® and of the customer and/or provider. These General Terms and Conditions of Sale take precedence over any general purchasing conditions that may be invoked by the customer and/or partner. The COMPAGNIE DES BATEAUX MOUCHES® makes these General Terms and Conditions of Sale available on its website so that the customer and/or partner can read them before making any booking.
II. RESERVATIONS
Regarding sightseeing cruises: Sightseeing-cruise tickets can be purchased online via the COMPAGNIE DES BATEAUX MOUCHES® website, directly at the ticket offices at the COMPAGNIE DES BATEAUX MOUCHES® site, or via a dedicated portal created and made available with a personal and secure access for authorized professionals. Sightseeing-cruise tickets are neither exchangeable nor refundable. The tickets are undated and valid for 2 years from the date of purchase. Slot reservations are not possible; boarding is available during opening hours subject to availability on board.
Regarding restaurant cruises: Prior booking is mandatory and can be made via the COMPAGNIE DES BATEAUX MOUCHES® website, in writing (reservations@bateaux-mouches.fr), by phone, via an authorized reseller or directly at the COMPAGNIE DES BATEAUX MOUCHES® site.
For individual restaurant cruises: Bookings become final after full payment of the total amount of the ordered service. Dining invitation cards are valid for 1 year from the date of purchase, with no possibility of extension and/or refund. Exchange vouchers are accepted only if issued by an intermediary authorized by the COMPAGNIE DES BATEAUX MOUCHES®.
For group restaurant cruises (+15 people):
For bookings made more than 30 days before the service: on the day of booking, a deposit equal to 50 % of the total price of the service is required. The remaining balance must be paid no later than 15 days before the service.
For bookings made less than 30 days before the service: full payment of the service must be made 15 working days before the service date. For groups of more than 15 people, the customer shall choose a fixed, single menu no later than 10 days before the service; after this deadline, a single menu will be imposed by the COMPAGNIE DES BATEAUX MOUCHES® head chef.
The exact number of guests must be confirmed to the COMPAGNIE DES BATEAUX MOUCHES® no later than 10 working days before the service date. In the event of a decrease in the number of passengers after booking and up to 10 working days before the service date, the COMPAGNIE DES BATEAUX MOUCHES® will issue a refund corresponding to the difference observed, capped at 10 % of the number of guests. Any increase in the number of passengers initially planned at the time of booking is subject to acceptance.
Regarding privatizations: A prior booking request is mandatory and can be made via the form on the COMPAGNIE DES BATEAUX MOUCHES® website, in writing (mice@bateaux-mouches.fr), by phone, via an authorized reseller or directly at the COMPAGNIE DES BATEAUX MOUCHES® site. Upon receipt by the COMPAGNIE DES BATEAUX MOUCHES® of the quotation and GTC signed by the customer, the latter will have an option period of 7 working days. At the end of this period, the booking becomes final and the customer shall owe a deposit equal to 50 % of the total price of the service.
The customer will receive booking confirmation by email. In the case of postal delivery, at the customer’s express request, shipping and handling costs will be invoiced in addition to the price of the service. When booking, the customer undertakes to comply with a minimum number of passengers. The COMPAGNIE DES BATEAUX MOUCHES® reserves the right to request a security deposit from the customer. The security deposit will be returned to the customer within 72 hours after the service has been performed, provided no damage has been found in the privatized areas. Any booking must be made by a customer at least 18 years old and legally capable of entering into a contract. Any booking becomes effective upon full or partial payment of the service by the customer.

The COMPAGNIE DES BATEAUX MOUCHES® reserves the right to apply special pricing as well as specific booking and cancellation conditions for particular events such as Valentine’s Day, Mother’s Day, 14 July, 31 December, etc. The COMPAGNIE DES BATEAUX MOUCHES® reserves the right not to accept bookings for events whose electoral, political or religious nature is incompatible with or may harm the image and shared mission of the COMPAGNIE DES BATEAUX MOUCHES® or the site. Any resale and/or marketing by a private and/or professional customer of the services offered by the COMPAGNIE DES BATEAUX MOUCHES® (sightseeing-cruise or dining tickets, etc.), without the express consent of the latter, is strictly prohibited and may give rise to legal action. Failure to comply with these rules will result in immediate suspension of the event without compensation. Any booking implies acceptance of these terms.
III. PRICES, INVOICING & PAYMENT
- Prices
The prices quoted by the COMPAGNIE DES BATEAUX MOUCHES® are expressed excl. VAT and/or incl. VAT (according to the VAT rate in force on the day of the service) and are set on the basis of the tariff conditions applicable on the effective date of the service. Service prices may be revised at any time without notice, in particular in the event of the introduction of new taxes or charges and/or changes to current charges and/or taxes, automatically resulting in a price adjustment. It is the customer’s responsibility to check that the price proposed by the COMPAGNIE DES BATEAUX MOUCHES® is acceptable before confirming the booking. No objection concerning the price of the service validated by the customer will be considered thereafter. After the service has been confirmed by the customer, the price of the booked service can no longer be changed. Services, items and additional hours not provided for at the time of booking will incur additional charges. For particular events such as Valentine’s Day, Mother’s Day, 14 July, 31 December, etc., special prices and menus will be offered for both individuals and groups. Authorized resellers undertake to maintain price parity with the public pricing granted by the COMPAGNIE DES BATEAUX MOUCHES®. One-off promotions are only possible if authorized by the COMPAGNIE DES BATEAUX MOUCHES®.
- Invoicing
Prepayment invoicing: Bookings become final after full payment of the total amount of the ordered service.
Deferred invoicing for business partners
Any deferred invoicing is subject to the express agreement of the COMPAGNIE DES BATEAUX MOUCHES®, which will inform the provider of the specific conditions imposed on this practice before any booking.
- Payment
Payment for the service may be made by cheque (only on a bank domiciled in France and upon presentation of a valid ID within 3 weeks prior to the event), by bank transfer, in cash or by bank card. Payment by bank card is secured by the SystemPay protocol, ensuring secure online transactions.
For bookings for restaurant cruises (individuals or more than 15 people) or privatizations made more than 30 days before the service: a deposit equal to 50 % of the total price of the service will be requested. The remaining balance must be paid strictly 15 days before the service.
For bookings for restaurant cruises (individuals or more than 15 people) or privatizations made less than 30 days before the service: full payment of the service will be required 15 working days before the service date.
The COMPAGNIE DES BATEAUX MOUCHES® reserves the right to request a security deposit for a privatization, a dry hire or the provision of one of its spaces.
The security deposit shall be paid by the customer before the service by bank cheque (only on a bank domiciled in France and upon presentation of a valid ID), by transfer, in cash or by bank card. The security deposit will be returned to the customer within 72 hours after the service has been performed if no damage has been found in the privatized areas.
If damage is found following the service, it shall be borne in full by the customer and the security deposit will not be returned.
For bookings for restaurant cruises (individuals or more than 15 people) or privatizations, the full amount of additional services consumed on board (drinks and food based on our supplements menu; additional hour(s), …) will be invoiced and must be paid directly on site before the end of the event.
The COMPAGNIE DES BATEAUX MOUCHES® cannot be held liable in the event of fraudulent use of a bank card on its website.
Any late payment will result, after a formal notice letter is sent, in the invoicing of late-payment interest at the statutory rate. In accordance with Article D. 441-5 of the French Commercial Code, a fixed compensation of €40 for collection costs shall be due by all professionals in the event of late payment.
IV. CANCELLATION TERMS FOR BOOKINGS
- Cancellation by the customer
For restaurant-cruise bookings (individuals or fewer than 15 people)
Any cancellation must be sent in writing (letter/email) to the COMPAGNIE DES BATEAUX MOUCHES® 72 hours before the service date. If the cancellation is made less than 72 hours before the service date, no refund will be made by the COMPAGNIE DES BATEAUX MOUCHES®. A date change may be offered by the COMPAGNIE DES BATEAUX MOUCHES® depending on availability within a maximum period of 6 months for a similar service.
Any no-show booking will not be refunded, and no postponement is possible. Sightseeing-cruise tickets are neither exchangeable nor refundable. The sightseeing-cruise tickets are valid for 2 years from the date of purchase.
For restaurant-cruise bookings (more than 15 people):
If the cancellation occurs more than 30 days before the service, the Compagnie des Bateaux-Mouches will refund the customer 100 % of the amounts paid at the time of booking.
If the cancellation occurs less than 29 days before the service, the COMPAGNIE DES BATEAUX MOUCHES® will refund the customer 30 % of the amounts paid at the time of booking.
If the cancellation occurs less than 15 working days before the service, the full amount is due and no refund will be made by the COMPAGNIE DES BATEAUX MOUCHES®.
For all individual or group bookings on special dates such as Valentine’s Day, Mother’s Day, 14 July, 25 December and 31 December, no refund will be made.
For privatizations of sightseeing boats, restaurant boats, rooms:
In the event of cancellation after receipt by the COMPAGNIE DES BATEAUX MOUCHES® of the quotation signed by the customer: If the cancellation occurs 90 days (3 months) before the event, the customer will receive 100 % of the amount paid at the time of booking. If the cancellation occurs between 89 days and 15 days before the service, the COMPAGNIE DES BATEAUX MOUCHES® offers the customer the possibility of receiving a credit valid for 6 months, subject to availability. If the cancellation occurs less than 15 days before the service, 100 % of the amount is due and the customer will not be entitled to a refund of the service. For special dates such as Valentine’s Day, Mother’s Day, 14 July, 31 December, etc., no refund will be made for either individual customers or groups. Gift vouchers are non-cancellable, non-refundable and non-modifiable.
CANCELLATION BY THE COMPAGNIE DES BATEAUX MOUCHES®:As cruises are subject to inland navigation rules, the COMPAGNIE DES BATEAUX MOUCHES® reserves the right to assess whether the river is navigable.
Cruises may be cancelled, or the route may be changed at any time from the time of booking, including on the scheduled departure day, pursuant to the above rules, or in the event of weather conditions likely to endanger the safety of passengers.
If the service is cancelled due to a government decision, prefectural order, natural disaster, bad weather or an event beyond the control of the COMPAGNIE DES BATEAUX MOUCHES®, a credit note for the amount of the initial service valid for 1 year will be offered.
In the event of partial cancellation of the service due to technical and/or operational problems, compensation commensurate with the loss will be proposed by the COMPAGNIE DES BATEAUX MOUCHES®.
In the event of total cancellation of the service, a full refund of the service price will be made by the COMPAGNIE DES BATEAUX MOUCHES®.
V. APPLICABLE REGULATIONS FOR CRUISES
The COMPAGNIE DES BATEAUX MOUCHES® will do everything in its power to ensure that the cruise runs smoothly under the conditions provided for at the time of booking.
The COMPAGNIE DES BATEAUX MOUCHES® cannot be held liable and/or required to pay any compensation and/or refund the total and/or partial price of the service in the event of changes to the schedules, boat and/or duration of the cruise due to force majeure or “« fortune de l’eau »”, or due to instructions given by the authorities in charge of navigation.
If necessary, the itinerary may be changed without notice.
The passenger or group of passengers must present themselves at the BATEAUX MOUCHES mooring point no later than 15 minutes before boarding.
If the passenger or group of passengers arrives after the boat has departed, they will not be entitled to any refund or compensation.
For a private cruise, the COMPAGNIE DES BATEAUX MOUCHES® reserves the right to reduce the cruise time by an amount equivalent to the customer’s delay at boarding. Each passenger must strictly comply with the instructions given by the boat’s crew in the interest of navigational safety and order on board.
No animals are allowed on board the boat, with the exception of dogs accompanying visually impaired persons.
No equipment deemed dangerous by the crew is allowed on board. In particular, it is strictly forbidden to bring and/or use flammable materials on board the boat and on the COMPAGNIE DES BATEAUX MOUCHES® site.
The COMPAGNIE DES BATEAUX MOUCHES® reserves the right to charge the customer for any material damage caused on board the boats and/or to the equipment present on the COMPAGNIE DES BATEAUX MOUCHES® site, by the customer or a member of the group.
Guests of the restaurant boats must present themselves for boarding for dinner cruises in appropriate attire. Prohibited: flip-flops, sandals, shorts and tank tops.
Otherwise, the Compagnie des Bateaux Mouches reserves the right to refuse access to the boats to customers who do not comply with these instructions. No refund will be made.
Customers who behave disrespectfully or aggressively towards other customers or staff, or who are intoxicated, will be refused access to the restaurant/sightseeing boats without the possibility of a refund.
It is forbidden for any passenger to enter, without permission, the engine room, as well as the wheelhouse and the kitchen.
VI. LIABILITY – INSURANCE
Only persons holding a travel document (ticket, boarding pass, etc.) validly issued by the COMPAGNIE DES BATEAUX MOUCHES® may, where applicable, claim compensation.
The COMPAGNIE DES BATEAUX MOUCHES® declines all responsibility for the consequences of passengers’ failure to comply with these T&Cs and with general and specific police regulations, without prejudice to any damages it may claim for the loss suffered as a result of such non-compliance.
The COMPAGNIE DES BATEAUX MOUCHES® cannot be held liable for damage to passengers during the cruise when such damage is caused by any of the following: sudden flooding, storm, collision with another vessel that is at least partly responsible for the accident, or any other unforeseeable event.
The COMPAGNIE DES BATEAUX MOUCHES® accepts no responsibility in the event of theft, loss, fall or damage to customers’ clothing, hand luggage or equipment (cameras, mobile phones, etc.) on the pontoon or on board the boats, or to their vehicles parked in the car park.
The COMPAGNIE DES BATEAUX MOUCHES® cannot be required to assist customers who are unable to attend on the agreed dates and times for reasons beyond its control.
The COMPAGNIE DES BATEAUX MOUCHES® declares that it is insured with an insurance company for its operational civil liability.
VII. INTELLECTUAL PROPERTY
The COMPAGNIE DES BATEAUX MOUCHES® holds all intellectual property rights relating to the trademarks COMPAGNIE DES BATEAUX MOUCHES®, MADEMOISELLE MOUCHE, as well as the website https://www.bateauxmouches.fr/fr, and all sites linked to the COMPAGNIE DES BATEAUX MOUCHES®. The customer is not authorized to reproduce, exploit, redistribute or use in any way, even partially, any elements of the COMPAGNIE DES BATEAUX MOUCHES® website without the express authorization of the latter.
VIII. CONFIDENTIALITY
The COMPAGNIE DES BATEAUX MOUCHES® and the customer undertake to keep confidential all information and documents that come to their knowledge in the course of performing the service.
IX. FORCE MAJEURE
The service may be cancelled by the customer and/or the COMPAGNIE DES BATEAUX MOUCHES® in the event of force majeure such as explosion, terrorist attacks, fire, natural disaster, administrative constraint… In this case, deposits paid will be refunded by the COMPAGNIE DES BATEAUX MOUCHES®, without the customer being entitled to any additional compensation.
X. PERSONAL DATA
In accordance with the provisions of the French Data Protection Act of 6 January 1978, the COMPAGNIE DES BATEAUX MOUCHES® processes personal data for the organization, management and invoicing of its services.
The personal data (surname, first name, date of birth, address, telephone number, nationality, etc.) processed, collected and stored have been previously provided voluntarily by the customer and are used by the COMPAGNIE DES BATEAUX MOUCHES® solely for professional purposes, in particular to organize the ordered service, manage the customer file, etc. Access to customers’ personal data is granted only to those persons and departments of the COMPAGNIE DES BATEAUX MOUCHES® responsible for ensuring performance of the booked service.
The data collected are retained and archived for a period necessary for the purposes for which they were collected, in compliance with the legal requirements in force.
Under applicable law, the Customer has the right to query, access, rectify and object on legitimate grounds with respect to all data concerning him/her.
For any information, the customer may send a registered letter to the COMPAGNIE DES BATEAUX MOUCHES®, Port de la Conférence / Pont de l’Alma, Rive droite – 75 008 Paris, or send an email to the following address: info@ bateaux-mouches.fr indicating the subject of the request.
The customer also has the right to lodge a complaint with the CNIL via its website. The COMPAGNIE DES BATEAUX MOUCHES® undertakes to ensure the security and confidentiality of the personal data provided by the customer.
XI. COMPLAINTS – MEDIATION
Any complaint regarding the service provided by the COMPAGNIE DES BATEAUX MOUCHES® must be sent by registered letter to the following address: COMPAGNIE DES BATEAUX MOUCHES® – Port de la Conférence / Pont de l’Alma, Rive droite – 75 008 Paris. In accordance with Articles L. 611-1 et seq. and R. 612-1 et seq. of the French Consumer Code, it is provided that for any contractual dispute concerning the performance of the sales contract and/or the provision of services that has not been resolved following a prior complaint submitted to our customer service, the customer may resort free of charge to mediation. He/She shall contact the Association Nationale des Médiateurs (ANM) either by post at 62 Rue Tiquetonne, Paris 2nd; or by email, by completing the online referral form at www.anmconso.com. The customer may also consult the website of the European Online Dispute Resolution platform (www.economie.gouv.fr/mediation-conso), which also contains all useful information in the event of a cross-border dispute.
XII. AMENDMENT OF THE GENERAL TERMS AND CONDITIONS
These General Terms and Conditions of Sale may be amended. The version applicable to the service is the one in force on the date it is signed.
XIII. DISPUTES: GOVERNING LAW AND COMPETENT JURISDICTION
Any dispute or controversy arising from the interpretation of these General Terms and Conditions and/or the performance of the services shall be governed exclusively by French law. Failing an amicable settlement, the matter shall be brought before the competent courts, it being specified that in the event of a dispute with a customer registered in the Trade and Companies Register (RCS), jurisdiction shall lie with the Commercial Court of Paris. With regard to disputes with consumers, Article R. 631-3 of the Consumer Code applies, which provides that “The consumer may bring proceedings before either one of the courts with territorial jurisdiction under the Code of Civil Procedure, or the court of the place where he/she was domiciled at the time the contract was concluded or the event occurred.”
